The Warren Commission

After the death of John F. Kennedy, his deputy, Lyndon B. Johnson, was appointed president. He immediately set up a commission to "ascertain, evaluate and report upon the facts relating to the assassination of the late President John F. Kennedy." The seven man commission was headed by Chief Justice Earl Warren and included Gerald Ford, Allen W. Dulles, John J. McCloy, Richard B. Russell, John S. Cooper and Thomas H. Boggs.

Lyndon B. Johnson also commissioned a report on the assassination from J. Edgar Hoover. Two weeks later the Federal Bureau of Investigation produced a 500 page report claiming that Lee Harvey Oswald was the sole assassin and that there was no evidence of a conspiracy. The report was then passed to the Warren Commission. Rather than conduct its own independent investigation, the commission relied almost entirely on the FBI report.

The Warren Commission was published in October, 1964. It reached the following conclusions:

(1) The shots which killed President Kennedy and wounded Governor Connally were fired from the sixth floor window at the southeast corner of the Texas School Book Depository.

(2) The weight of the evidence indicates that there were three shots fired.

(3) Although it is not necessary to any essential findings of the Commission to determine just which shot hit Governor Connally, there is very persuasive evidence from the experts to indicate that the same bullet which pierced the President's throat also caused Governor Connally's wounds. However, Governor Connally's testimony and certain other factors have given rise to some difference of opinion as to this probability but there is no question in the mind of any member of the Commission that all the shots which caused the President's and Governor Connally's wounds were fired from the sixth floor window of the Texas School Book Depository.

(4) The shots which killed President Kennedy and wounded Governor Connally were fired by Lee Harvey Oswald.

(5) Oswald killed Dallas Police Patrolman J. D. Tippit approximately 45 minutes after the assassination.

(6) Within 80 minutes of the assassination and 35 minutes of the Tippit killing Oswald resisted arrest at the theater by attempting to shoot another Dallas police officer.

(7) The Commission has found no evidence that either Lee Harvey Oswald or Jack Ruby was part of any conspiracy, domestic or foreign, to assassinate President Kennedy.

(8) In its entire investigation the Commission has found no evidence of conspiracy, subversion, or disloyalty to the U.S. Government by any Federal, State, or local official.

(9) On the basis of the evidence before the Commission it concludes that, Oswald acted alone.

(1) Peter Dale Scott, Deep Politics and the Death of JFK (1993)

At the first meeting of the newly constituted Warren Commission, Allen Dulles handed out copies of a book to help define the ideological parameters he proposed for the Commission's forthcoming work. American assassinations were different from European ones, he told the Commission. European assassinations were the work of conspiracies, whereas American assassins acted alone. Someone was alert enough to remind Dulles of the Lincoln assassination, when Lincoln and two members of his cabinet were shot simultaneously in different parts of Washington. But Dulles was not stopped for a second: years of dissembling in the name of "intelligence" were not to fail him in this challenge. He simply retorted that the killers in the Lincoln case were so completely under the control of one man (John Wilkes Booth), that the three killings were virtually the work of one man.

Dulles's logic here (or, as I prefer to call it, his paralogy) was not idiosyncratic, it was institutional. As we have seen, J. Edgar Hoover had already, by November 25, committed his own reputation and the Bureau to the conclusion that Oswald had done it, and acted alone. Chief Justice Warren knew this, yet said at the same meeting, "We can start with the premise that we can rely upon the reports of the various agencies that have been engaged in the investigation." John J. McCloy spoke for the extra-governmental establishment when he added that it was of paramount importance to "show the world that America is not a banana republic, where a government can be changed by conspiracy.

 

(2) The Warren Commission Report (September, 1964)

(1) The shots which killed President Kennedy and wounded Governor Connally were fired from the sixth floor window at the southeast corner of the Texas School Book Depository. This determination is based upon the following:

Witnesses at the scene of the assassination saw a rifle being fired from the sixth-floor window of the Depository Building, and some witnesses saw a rifle in the window immediately after the shots were fired.

The nearly whole bullet found on Governor Connally's stretcher at Parkland Memorial Hospital and the two bullet fragments found in the front seat of the Presidential limousine were fired from the 6.5-millimeter Mannlicher-Carcano rifle found on the sixth floor of the Depository Building to the exclusion of all other weapons.

The three used cartridge cases found near the window on the sixth floor at the southeast corner of the building were fired from the same rifle which fired the above - described bullet and fragments, to the exclusion of all other weapons.

The windshield in the Presidential limousine was struck by a bullet fragment on the inside surface of the glass, but was not penetrated.

The nature of the bullet wounds suffered by President Kennedy and Governor Connally and the location of the car at the time of the shots establish that the bullets were fired from above and behind the Presidential limousine, striking the President and the Governor as follows:

President Kennedy was first struck by a bullet which entered at the back of his neck and exited through the lower front portion of his neck, causing a wound which would not necessarily have been lethal. The President was struck a second time by a bullet which entered the right-rear portion of his head, causing a massive and fatal wound.

Governor Connally was struck by a bullet which entered on the right side of his back and traveled downward through the right side of his chest, exiting below his right nipple. This bullet then passed through his right wrist and entered his left thigh where it caused a superficial wound.

There is no credible evidence that the shots were fired from the Triple Underpass, ahead of the motorcade, or from any other location.

(2) The weight of the evidence indicates that there were three shots fired.

(3) Although it is not necessary to any essential findings of the Commission to determine just which shot hit Governor Connally, there is very persuasive evidence from the experts to indicate that the same bullet which pierced the President's throat also caused Governor Connally's wounds. However, Governor Connally's testimony and certain other factors have given rise to some difference of opinion as to this probability but there is no question in the mind of any member of the Commission that all the shots which caused the President's and Governor Connally's wounds were fired from the sixth floor window of the Texas School Book Depository.

(4) The shots which killed President Kennedy and wounded Governor Connally were fired by Lee Harvey Oswald. This conclusion is based upon the following:

The Mannlicher-Carcano 6.5 - millimeter Italian rifle from which the shots were fired was owned by and in the possession of Oswald.

Oswald carried this rifle into the Depository Building on the morning of November 22, 1963.

Oswald, at the time of the assassination, was present at the window from which the shots were fired.

Shortly after the assassination, the Mannlicher-Carcano rifle belonging to Oswald was found partially hidden between some cartons on the sixth floor and the improvised paper bag in which Oswald brought the rifle to the Depository was found close by the window from which the shots were fired.

Based on testimony of the experts and their analysis of films of the assassination, the Commission has concluded that a rifleman of Lee Harvey Oswald's capabilities could have fired the shots from the rifle used in the assassination within the elapsed time of the shooting. The Commission has concluded further that Oswald possessed the capability with a rifle which enabled him to commit the assassination.

Oswald lied to the police after his arrest concerning important substantive matters.

Oswald had attempted to kill Maj. Gen. Edwin A. Walker (Resigned, U.S. Army) on April 10, 1963, thereby demonstrating his disposition to take human life.

(5) Oswald killed Dallas Police Patrolman J. D. Tippit approximately 45 minutes after the assassination. This conclusion upholds the finding that Oswald fired the shots which killed President Kennedy and wounded Governor Connally and is supported by the following:

Two eyewitnesses saw the Tippit shooting and seven eyewitnesses heard the shots and saw the gunman leave the scene with revolver in hand. These nine eyewitnesses positively identified Lee Harvey Oswald as the man they saw.
The cartridge cases found at the scene of the shooting were fired from the revolver in the possession of Oswald at the time of his arrest to the exclusion of all other weapons.

The revolver in Oswald's possession at the time of his arrest was purchased by and belonged to Oswald.

Oswald's jacket was found along the path of flight taken by the gunman as he fled from the scene of the killing.

(6) Within 80 minutes of the assassination and 35 minutes of the Tippit killing Oswald resisted arrest at the theater by attempting to shoot another Dallas police officer.

(7) The Commission has reached the following conclusions concerning Oswald's interrogation and detention by the Dallas police:

Except for the force required to effect his arrest, Oswald was not subjected to any physical coercion by any law enforcement officials. He was advised that he could not be compelled to give any information and that any statements made by him might be used against him in court. He was advised of his right to counsel. He was given the opportunity to obtain counsel of his own choice and was offered legal assistance by the Dallas Bar Association, which he rejected at that time.

Newspaper, radio, and television reporters were allowed uninhibited access to the area through which Oswald had to pass when he was moved from his cell to the interrogation room and other sections of the building, thereby subjecting Oswald to harassment and creating chaotic conditions which were not conducive to orderly interrogation or the protection of the rights of the prisoner.

The numerous statements, sometimes erroneous, made to the press by various local law enforcement officials, during this period of confusion and disorder in the police station, would have presented serious obstacles to the obtaining of a fair trial for Oswald. To the extent that the information was erroneous or misleading, it helped to create doubts, speculations, and fears in the mind of the public which might otherwise not have arisen.

(8) The Commission has reached the following conclusions concerning the killing of Oswald by Jack Ruby on November 24, 1963:

Ruby entered the basement of the Dallas Police Department shortly after 11:17 a.m. and killed Lee Harvey Oswald at 11:21 a.m.

Although the evidence on Ruby's means of entry is not conclusive, the weight of the evidence indicates that he walked down the ramp leading from Main Street to the basement of the police department.

There is no evidence to support the rumor that Ruby may have been assisted by any members of the Dallas Police Department in the killing of Oswald.

The Dallas Police Department's decision to transfer Oswald to the county jail in full public view was unsound. The arrangements made by the police department on Sunday morning, only a few hours before the attempted transfer, were inadequate. Of critical importance was the fact that news media representatives and others were not excluded from the basement even after the police were notified of threats to Oswald's life. These deficiencies contributed to the death of Lee Harvey Oswald.

(9) The Commission has found no evidence that either Lee Harvey Oswald or Jack Ruby was part of any conspiracy, domestic or foreign, to assassinate President Kennedy. The reasons for this conclusion are:

The Commission has found no evidence that anyone assisted Oswald in planning or carrying out the assassination. In this connection it has thoroughly investigated, among other factors, the circumstances surrounding the planning of the motorcade route through Dallas, the hiring of Oswald by the Texas School Book Depository Co. on October 15, 1963, the method by which the rifle was brought into the building, the placing of cartons of books at the window, Oswald's escape from the building, and the testimony of eyewitnesses to the shooting.

The Commission has found no evidence that Oswald was involved with any person or group in a conspiracy to assassinate the President, although it has thoroughly investigated, in addition to other possible leads, all facets of Oswald's associations, finances, and personal habits, particularly during the period following his return from the Soviet Union in June 1962.

The Commission has found no evidence to show that Oswald was employed, persuaded, or encouraged by any foreign government to assassinate President Kennedy or that he was an agent of any foreign government, although the Commission has reviewed the circumstances surrounding Oswald's defection to the Soviet Union, his life there from October of 1959 to June of 1962 so far as it can be reconstructed, his known contacts with the Fair Play for Cuba Committee and his visits to the Cuban and Soviet Embassies in Mexico City during his trip to Mexico from September 26 to October 3, 1963, and his known contacts with the Soviet Embassy in the United States.

The Commission has explored all attempts of Oswald to identify himself with various political groups, including the Communist Party, U.S.A., the Fair Play for Cuba Committee, and the Socialist Workers Party, and has been unable to find any evidence that the contacts which he initiated were related to Oswald's subsequent assassination of the President.

All of the evidence before the Commission established that there was nothing to support the speculation that Oswald was an agent, employee, or informant of the FBI, the CIA, or any other governmental agency. It has thoroughly investigated Oswald's relationships prior to the assassination with all agencies of the U.S. Government. All contacts with Oswald by any of these agencies were made in the regular exercise of their different responsibilities.

No direct or indirect relationship between Lee Harvey Oswald and Jack Ruby has been discovered by the Commission, nor has it been able to find any credible evidence that either knew the other, although a thorough investigation was made of the many rumors and speculations of such a relationship.

The Commission has found no evidence that Jack Ruby acted with any other person in the killing of Lee Harvey Oswald.

After careful investigation the Commission has found no credible evidence either that Ruby and Officer Tippit, who was killed by Oswald, knew each other or that Oswald and Tippit knew each other. Because of the difficulty of proving negatives to a certainty the possibility of others being involved with either Oswald or Ruby cannot be established categorically, but if there is any such evidence it has been beyond the reach of all the investigative agencies and resources of the United States and has not come to the attention of this Commission.

(10) In its entire investigation the Commission has found no evidence of conspiracy, subversion, or disloyalty to the U.S. Government by any Federal, State, or local official.

(11) On the basis of the evidence before the Commission it concludes that, Oswald acted alone. Therefore, to determine the motives for the assassination of President Kennedy, one must look to the assassin himself. Clues to Oswald's motives can be found in his family history, his education or lack of it, his acts, his writings, and the recollections of those who had close contacts with him throughout his life. The Commission has presented with this report all of the background information bearing on motivation which it could discover. Thus, others may study Lee Oswald's life and arrive at their own conclusions as to his possible motives. The Commission could not make any definitive determination of Oswald's motives. It has endeavored to isolate factors which contributed to his character and which might have influenced his decision to assassinate President Kennedy. These factors were:

His deep-rooted resentment of all authority which was expressed in a hostility toward every society in which he lived;

His inability to enter into meaningful relationships with people, and a continuous pattern of rejecting his environment in favor of new surroundings;

His urge to try to find a place in history and despair at times over failures in his various undertakings;

His capacity for violence as evidenced by his attempt to kill General Walker;

His avowed commitment to Marxism and communism, as he understood the terms and developed his own interpretation of them; this was expressed by his antagonism toward the United States, by his defection to the Soviet Union, by his failure to be reconciled with life in the United States even after his disenchantment with the Soviet Union, and by his efforts, though frustrated, to go to Cuba. Each of these contributed to his capacity to risk all in cruel and irresponsible actions.

(12) The Commission recognizes that the varied responsibilities of the President require that he make frequent trips to all parts of the United States and abroad. Consistent with their high responsibilities Presidents can never be protected from every potential threat. The Secret Service's difficulty in meeting its protective responsibility varies with the activities and the nature of the occupant of the Office of President and his willingness to conform to plans for his safety. In appraising the performance of the Secret Service it should be understood that it has to do its work within such limitations. Nevertheless, the Commission believes that recommendations for improvements in Presidential protection are compelled by the facts disclosed in this investigation.

The complexities of the Presidency have increased so rapidly in recent years that the Secret Service has not been able to develop or to secure adequate resources of personnel and facilities to fulfill its important assignment. This situation should be promptly remedied.

The Commission has concluded that the criteria and procedures of the Secret Service designed to identify and protect against persons considered threats to the president were not adequate prior to the assassination.

The Protective Research Section of the Secret Service, which is responsible for its preventive work, lacked sufficient trained personnel and the mechanical and technical assistance needed to fulfill its responsibility.

Prior to the assassination the Secret Service's criteria dealt with direct threats against the President. Although the Secret Service treated the direct threats against the President adequately, it failed to recognize the necessity of identifying other potential sources of danger to his security. The Secret Service did not develop adequate and specific criteria defining those persons or groups who might present a danger to the President. In effect, the Secret Service largely relied upon other Federal or State agencies to supply the information necessary for it to fulfill its preventive responsibilities, although it did ask for information about direct threats to the President.

The Commission has concluded that there was insufficient liaison and coordination of information between the Secret Service and other Federal agencies necessarily concerned with Presidential protection. Although the FBI, in the normal exercise of its responsibility, had secured considerable information about Lee Harvey Oswald, it had no official responsibility, under the Secret Service criteria existing at the time of the President's trip to Dallas, to refer to the Secret Service the information it had about Oswald. The Commission has concluded, however, that the FBI took an unduly restrictive view of its role in preventive intelligence work prior to the assassination. A more carefully coordinated treatment of the Oswald case by the FBI might well have resulted in bringing Oswald's activities to the attention of the Secret Service.

The Commission has concluded that some of the advance preparations in Dallas made by the Secret Service, such as the detailed security measures taken at Love Field and the Trade Mart, were thorough and well executed. In other respects, however, the Commission has concluded that the advance preparations for the President's trip were deficient.

Although the Secret Service is compelled to rely to a great extent on local law enforcement officials, its procedures at the time of the Dallas trip did not call for well-defined instructions as to the respective responsibilities of the police officials and others assisting in the protection of the President.

The procedures relied upon by the Secret Service for detecting the presence of an assassin located in a building along a motorcade route were inadequate. At the time of the trip to Dallas, the Secret Service as a matter of practice did not investigate, or cause to be checked, any building located along the motorcade route to be taken by the President. The responsibility for observing windows in these buildings during the motorcade was divided between local police personnel stationed on the streets to regulate crowds and Secret Service agents riding in the motorcade. Based on its investigation the Commission has concluded that these arrangements during the trip to Dallas were clearly not sufficient.

The configuration of the Presidential car and the seating arrangements of the Secret Service agents in the car did not afford the Secret Service agents the opportunity they should have had to be of immediate assistance to the President at the first sign of danger.

Within these limitations, however, the Commission finds that the agents most immediately responsible for the President's safety reacted promptly at the time the shots were fired from the Texas School Book Depository Building.

 

(3) Bertrand Russell, 16 Questions on the Assassination (6th September 1964)

The official version of the assassination of President Kennedy has been so riddled with contradictions that it is been abandoned and rewritten no less than three times. Blatant fabrications have received very widespread coverage by the mass media, but denials of these same lies have gone unpublished.

Photographs, evidence and affidavits have been doctored out of recognition. Some of the most important aspects of the case against Lee Harvey Oswald have been completely blacked out. Meanwhile, the F.B.I., the police and the Secret Service have tried to silence key witnesses or instruct them what evidence to give. Others involved have disappeared or died in extraordinary circumstances.

It is facts such as these that demand attention, and which the Warren Commission should have regarded as vital. Although I am writing before the publication of the Warren Commission’s report, leaks to the press have made much of its contents predictable. Because of the high office of its members and the fact of its establishment by President Johnson, the Commission has been widely regarded as a body of holy men appointed to pronounce the truth. An impartial examination of the composition and conduct of the Commission suggests quite otherwise.

The Warren Commission has been utterly unrepresentative of the American people. It consisted of two Democrats, Senator Russell of Georgia and Congressman Boggs of Louisiana, both of whose racist views have brought shame on the United States; two Republicans, Senator Cooper of Kentucky and Congressman Gerald R. Ford of Michigan, the latter of whom is a leader of his local Goldwater movement and an associate of the F.B.I.; Allen Dulles, former director of the Central Intelligence Agency, and Mr. McCloy, who has been referred to as the spokesman for the business community. Leadership of the filibuster in the Senate against the Civil Rights Bill prevented Senator Russell from attending hearings during the period. The Chief Justice of the United States Supreme Court, Earl Warren, who rightly commands respect, was finally persuaded, much against his will, to preside over the Commission, and it was his involvement above all else that helped lend the Commission an aura of legality and authority. Yet many of its members were also members of those very groups which have done so much to distort and suppress the facts about the assassination. Because of their connection with the Government, not one member would have been permitted under U.S. law to serve on a jury had Oswald faced trial. It is small wonder that the Chief Justice himself remarked that the release of some of the Commission’s information “might not be in your lifetime” Here, then, is my first question: Why were all the members of the Warren Commission closely connected with the U.S. Government?

If the composition of the Commission was suspect, its conduct confirmed one’s worst fears. No counsel was permitted to act for Oswald, so that cross-examination was barred. Later, under pressure, the Commission appointed the President of the American Bar Association, Walter Craig, one of the supporters of the Goldwater movement in Arizona, to represent Oswald. To my knowledge, he did not attend hearings, but satisfied himself with representation by observers.

In the name of national security, the Commission’s hearings were held in secret, thereby continuing the policy which has marked the entire course of the case. This prompts my second question: If, as we are told, Oswald was the lone assassin, where is the issue of national security? Indeed, precisely the same question must be put here as was posed in France during the Dreyfus case: If the Government is so certain of its case, why has it conducted all its inquiries in the strictest secrecy?

 

(4) Harold Weisberg , Whitewash: The Report on the Warren Report (1966)

There is in neither the Commission's Report nor in any of the 26 printed volumes of its hearings and exhibits any sign that the Commission considered this assassination as a political crime, an unvarying characteristic of all assassinations. Likewise, despite the great amount of space devoted to the subject of conspiracy, there is no sign of any real quest for evidence of conspiracy in the broad or political sense. Both the FBI and the Commission decided, as had the police before them, that Oswald was their legitimate prey. Nowhere in the Report is there any evidence that any other assassin or assassins were ever sought or considered. Can anything be logically concluded other than that nobody wanted to find a different assassin or any additional assassin?

Yet there were abundant and obvious indications of both suspicion of a conspiracy and of its existence. The Report was able to avoid them, a task made easier by the nature of the hearings. It was as successful in avoiding both the obvious indications and the even more obvious suspicions, some of which are dealt with in this book.

The superficial and immature manner in which the Report deals with the possibility of a conspiracy or of a different assassin is only one of the ways in which the Commission may have crippled itself. Despite references in both the Report and the press to the Commission's investigators, the fact is that, in the accepted sense, the Commission had no investigators of its own. It drew upon the men available in the Executive Branch, chiefly the FBI and Secret Service, who were not employees of the Commission and whose primary responsibilities were to those who did employ them.

While there is no suggestion that these agencies were in any way involved m the assassination, they were, nonetheless, subject to Commission criticism and they were, in fact, so criticized. In addition, the Secret Service was directly responsible for the President's welfare and safety, and he was killed while they were protecting him. Besides its normal duty of aiding the Secret Service, the FBI had Oswald under surveillance or investigation at the time the President was killed. He was what might be called an "active" case.

Therefore, both agencies and their employees had personal involvements in the investigation that amounted to conflicts of interest. On one hand was the need for a complete, impartial and exhaustive investigation regardless of where it led and what it showed. On the other, the reputations of the agencies and their employees could have been at stake, for any error, no matter how innocent, could have made the Dallas tragedy possible. This situation was unfair to the agencies, which did not create it, and could have burdened them with impermissible conflicts and temptations, no matter how unconsciously. Further, the Dallas representatives of these agencies had ties of friendship and sometimes long association with the local police and, when the investigation of the assassination was over, faced the need for continuing, day-to-day working associations with them. Contemporarily and historically, it would have been better if the Commission had had its own staff of investigators in the field and had restricted its use of the FBI and Secret Service to technical services.

 

(5) Peter Dale Scott, Deep Politics and the Death of JFK (1993)

FBI documents released in 1979 show other instances in which key information was either altered before it reached the Warren Commission, or else withheld altogether. For example, judging from Warren Commission records, the FBI covered up Jack Ruby's connections to organized crime. The Commission did not receive an important interview with Luis Kutner, a Chicago lawyer who had just told the press (correctly) about Ruby's connections to Chicago mobsters Lennie Patrick and Dave Yaras. All the FBI transmitted was a meaningless follow-up interview in which Kutner merely said he had no additional information.

Apparently the FBI also failed to transmit a teletype revealing that Yaras, a national hit man for the Chicago syndicate who had grown up with Ruby, and who had been telephoned by one of Ruby's Teamster contacts on the eve of the assassination, was about to attend a "hoodlum meeting" of top East and West Coast syndicate representatives, including some from the "family" of the former Havana crime lord Santos Trafficante.

 

(6) Gaeton Fonzi, speech on receiving the Mary Ferrell-JFKLancer Pioneer Award (21st November 21, 1998)

Like most other Americans, after the initial shock of President Kennedy's assassination had dimmed, we fell into the comfortable assumption that the Government was handling the matter judiciously, that the prestigious panel of respected individuals, headed by the most prestigious member of the American judicial system, would provide us with a thorough and valid appraisal of exactly what had happened when President Kennedy was killed. What led me to clip the article by Vincent Salandria is that it ran counter to that assumption.

It dealt with only one aspect of the report - the sequence of events surrounding the number and direction of the shots. But that just happened to be the area assigned to another Philadelphia lawyer, a young assistant district attorney whose quick intelligence and impressive record had landed him a staff job on the Warren Commission. His name, of course, was Arlen Specter.

I didn't initially understand some of the technical and complex points Salandria made in his article, but I did grasp the fact that what Salandria was implying was that the Warren Commission Report was wrong...

Local reporters had, of course, asked Specter about the Warren Report when it was released. He was vigorous in defense of its conclusions. He called the Commission's investigation the most exhaustive and complete in history. The single bullet theory, he insisted, was the only possible way to explain how Lee Harvey Oswald had shot President Kennedy. The reporters dutifully reported what he said.

Amazingly enough, even after all those months had gone by since the release of the Warren Report, I was the first journalist to ask Specter about specific details and about the Report's inconsistencies. I apparently caught Specter off guard.

I was shocked by his confusions, his hemming and hawing, his hesitations and evasions. This from someone who was the epitome of the always cool, collected and verbally masterful lawyer, the former star of the Yale Law debating team. I was even more shocked by his inability to provide valid explanations for some of the most blatant inconsistencies in the Report.

I believe the most crucial was the discrepancy between the levels of the so-called "exit" wound in Kennedy's throat and the holes in the back of Kennedy's jacket and shirt. Why were the holes in his back lower than the hole in Kennedy's throat? I still remember Specter hesitating, stuttering, making a few false starts in attempting to answer that question. Finally, he got up from his desk and came around to stand behind me. Well, he said, it was because the President was waving his arm, and then, trying to illustrate why the jacket would ride up, Specter pulled my arm high over my head - far higher than the Zapruder film showed Kennedy waving his hand. "Wave your arm a few times," Specter said, "wave at the crowd." And then jabbing a finger at the base of my neck - not six inches below my collar, where the holes in Kennedy's jacket and shirt were - Specter said, "Well, see, if the bullet goes in here, the jacket gets hunched up. If you take this point right here and then you strip the coat down, it comes out at a lower point."

"A lower point?" I repeated, wondering if Specter were trying to confuse me or was confused himself.

If the entrance holes were at a lower point than the exit hole, how could Oswald have shot Kennedy from the sixth floor window of the Book Depository?

In the end, Specter admitted they had what he described as - quote - "some problems with that."

My interviews also revealed that the Commission had "some problems" with other troublesome evidence, including the so-called "pristine" bullet, the angle of Governor Connally's wounds, the timing of the shots. "Some problems," indeed.
I'll never forget the numbing disbelief I came away with after my interviews with Specter. Vince Salandria was right, the Warren Report was wrong, there had to have been a conspiracy.

We were young once and not so brave. We wanted to cling to the myth of a mystery. We wanted to hang onto the questions of motivation and parade the usual suspects and the illusion of a dilemma before the American people. Could the Mob have killed President Kennedy? Could the KGB have killed President Kennedy? Could Castro have killed President Kennedy? Could anti-Castro Cubans have killed President Kennedy? Could the CIA have killed President Kennedy?

I suggest to you that if it ever becomes known what specific individuals comprised the apparatus that killed Kennedy, those individuals will have some association with any or all of the above. And still the emergence of such individuals, dead or alive, will add but inconsequential detail to the truth about the assassination. Because we have known -- and have long known - who killed President Kennedy.

Could any but a totally controlling force - a power elite within the United States Government itself - call it what you will, the military-intelligence complex, the national security state, the corporate-warfare establishment - could any but the most powerful elite controlling the U.S. Government have been able to manipulate individuals and events before the assassination and then bring such a broad spectrum of internal forces to first cover up the crime and then control the institutions within our society to keep the assassination of President Kennedy a false mystery for 35 years?

Is there any doubt that the Warren Commission deliberately set out not to tell the American people the truth?

There is a brief glimpse, an illustration of the level at which that deceit was carried out, in an incident that occurred during the Warren Commission's investigation. Commission chairman Earl Warren himself, with then Representative Gerald Ford at his side, was interviewing a barman, Curtis LaVerne Crafard. Crafard had worked at Jack Ruby's Carousel Club before he was seized by FBI men as he was hightailing it out of town the day after the assassination, having told someone, "They are not going to pin this on me!"

In the interview, Warren asks Craford what he did before he was a bartender.

"I was a Master sniper in the Marine Corps," Craford answered.*

The next question that Warren immediately asked was: "What kind of entertainment did they have at the club?"

 

(7) Edward Jay Epstein, The Warren Report: Part 4, CBS Television (28th June, 1967)

Well, there were three, I think, levels of complaint. The first one was the institutional, you might say: the general problem that a government has when it searches for truth. The problem of trying to have an autonomous investigation, free from political interference, and at the same time, it's dealing by its very nature with a political problem.

The second level might be called the organizational level of - was the Warren Commission organized in a way that prevented it from finding facts? And here my findings were that by using a part time staff and by the Commission's detaching themselves from the investigation - in other words, not actively partaking in the investigation - it raised some problems as to whether the Warren Commission's investigation went deep enough, so that if there was evidence of a conspiracy, they would have in fact found it.

The third level of my criticism concerned the evidence itself, and this concerned the problem of when the Warren Commission was come - confronted with a very complex problem. For example, the contradiction between the FBI summary report on the autopsy and the autopsy report they had in hand - how they solved this problem, whether they simply glossed over it or whether they called witnesses, and - and this - this, of course, brought up the questions of - of a second assassin.

 

(8) John J. McCloy, The Warren Report: Part 4, CBS Television (28th June, 1967)

There have been a number of suggestions that the Commission, for example, was only motivated by a desire to put - to make things quiet, so as to give comfort to the Administration, or give comfort to the people of the country, that there was nothing vicious about this. Well, that wasn't the attitude that we had at all.

I know what my attitude, when I first went down, I was convinced that there was something phony between the Ruby and the Oswald affair, that forty-eight hours after the assassination, here's this man shot in the police station. I was pretty skeptical about that. But as time went on and we heard witnesses and weighed the witnesses - but just think how silly this charge is.

Here we were seven men, I think five of us were Republicans. We weren't beholden to any Administration. Besides that, we - we had our own integrity to think of. A lot of people have said that you can rely upon the distinguished character of the Commission. You don't need to rely on the distinguished character of the Commission. Maybe it was distinguished, and maybe it wasn't. But you can rely on common sense. And you know that seven men aren't going to get together, of that character, and concoct a conspiracy, with all of the members of the staff we had, with all of the investigative agencies - it would have been a conspiracy of a character so mammoth and so vast that it transcends any - even some of the distorted charges of conspiracy on the part of Oswald.

I think that if there's one thing I would do over again, I would insist on those photographs and the X-rays having been produced before us. In the one respect, and only one respect there, I think we were perhaps a little oversensitive to what we understand was the sensitivities of the Kennedy family against the production of colored photographs of the body, and so forth.

But those exist. They're there. We had the best evidence in regard to that-the pathology in respect to the President's wounds. It was our own choice that we didn't subpoena these photographs, which were then in the hands of the Kennedy family. I say, I wish-I don't think we'd have subpoenaed them. We could have gotten - Mr. Justice Warren was talking to the Kennedy family about that at that time. I thought that he was really going to see them, but it turned out that he hadn't.

 

(9) Sylvia Meagher and Gary Owen, Master Index to the John F. Kennedy Assassination Investigations (1980)

Study of the Hearings and Exhibits has destroyed the grounds for confidence in the Warren Report. Study has shown the Report to contain (1) statements of fact which are inaccurate and untrue, in the light of the official Exhibits and objective verification; (2) statements for which the citations fail to provide authentication; (3) misrepresentation of the testimony; (4) omission of references to testimony inimical to findings in the Report; (5) suppression of findings favorable to Oswald; (6) incomplete investigation of suspicious circumstances which remain unexplained; (7) misleading statements resulting from inadequate attention to the contents of Exhibits; (8) failure to obtain testimony from crucial witnesses; and (9) assertions which are diametrically opposite to the logical inferences to be drawn from the relevant testimony or evidence.

 

(10) Michael Kurtz, Crime of the Century: The Kennedy Assassination From a Historians Perspective (1982)

Several former Warren Commission staff members stated that had they known about such matters as ClA-sponsored assassination plots against Fidel Castro, they would have looked into the possibility of a conspiracy much more carefully. The CIA assassination papers also include many censored documents concerning such topics as Lee Harvey Oswald, David Ferrie, Cuba, and Russia.

Faced with a "definitive" five-hundred-page FBI assassination report, pressured to meet its deadline, and hampered by the lack of complete evidence, the Warren Commission failed to accomplish its prescribed duty of ascertaining all the facts about the assassination. The commission operated in secret and under procedural rules that virtually guaranteed a biased investigation. Presuming Lee Harvey Oswald guilty, the commission simply ignored evidence to the contrary.

 

(11) Ronald F. White, Apologists and Critics of the Lone Gunman Theory, included in Assassination Science (1998)

Based on their examination of the bolt-action, clip-fed, Mannlicher-Carcano rifle, firearms experts for the Warren Commission established that at least 2.3 seconds per shot would be required for Oswald to execute the assassination. The shutter speed of Abraham Zapruder s Bell and Howell movie camera operated at about 18.3 frames per second. After numbering each individual frame, tracing the movement of the vehicle, and taking into account other factors, the Commission hypothesized that since the view from the snipers nest would have been obscured by the foliage of an oak tree between frames Z-167 and Z-210, the earliest the president could have been shot was Z-210. Zapruders view of the motorcade was blocked by a road sign between frames Z-207 and Z-225, but when Kennedy appears from behind the sign he is beginning to react to the throat wound. The commission therefore reasoned that the President was shot in the neck between frames Z-210 and Z-225. Based on Connally's reactions in the Zapruder film, he was apparently struck between Z-236 and Z-238. These observations, however, were puzzling. If Kennedy was struck in the back at Z-225 and Connally at Z-238, that would entail a 13-frame time span or 0.71 seconds. But that would have been impossible since Oswald would have needed at least 2.3 seconds to fire two shots. Even if Kennedy was shot as early as Z-210, that would still be only a 28 frame time span, or 1.53 seconds. Therefore, Oswald apparently could not have shot both Kennedy and Connally. Logically this left the Warren Commission four options: abandon the lone gunman theory, assume that Oswald somehow managed to hit the President while shooting through the tree, lower the 2.3 second estimate of the time required to operate the rifle mechanism, or assume that a single bullet struck both Kennedy and Connally. The Commission took the fourth option, known as the "single bullet hypothesis," and concluded that three shots were fired within a 4.8 to 7 second time lapse, and that at least one of the three probably missed the target, although they could not determine with certainty which of the three missed....

Since the Warren Commission elected not to extend the time frame in this way, they concluded that the entire assassination took place between frames Z-210 and Z-313, or a time span of 5.62 seconds, just enough time to get off three shots. Any competent gunman would have had the rifle already cocked for the first shot, in which case the bolt would have been operated only twice and the absolute minimum time expended operating the bolt would have been 4.6 seconds. But if four shots were fired, the rifle would have been cocked three times requiring 6.9 seconds. So, if four shots were fired there must have been more than one gunman at Dealey Plaza. Of course, if the Commission had accepted the possibility that the first shot was fired through the tree at Z-166, then their estimate of 5.62 seconds could be extended by 2.4 seconds to about 8 seconds, more than enough time for a lone gunman to get off even four shots.

 

(12) Fred Litwin, Fair Play Magazine, Intellectual Dishonesty in the JFK Assassination (March, 1995)

The critics of the Warren Commission claim there was a conspiracy to assassinate President Kennedy. If we assume they are correct, then exactly how big was the conspiracy to kill JFK? Are we talking about one assassin with an accomplice or are we talking about something larger? If one were to believe the current literature, we are faced with not just "something larger" but a monster conspiracy that consists of several assassins, several accomplices, and the destruction and forgery of vital evidence. The critics have constructed a conspiracy so massive that it ultimately falls of its own weight.

Where did such a monster conspiracy come from? In the sixties, the critical literature pointed out the many failings of the Warren Commission. The most effective book of that decade, Accessories After the Fact by Sylvia Meagher, highlighted the many inconsistencies in the evidence and the many unanswered questions about the assassination. Her book quickly went out of print and became an underground bestseller -- photocopies were widely sold within the assassination research community. Meagher went out of her way to ask more questions than to provide answers.

In the seventies, the critical literature started to look at the political undertones of a possible conspiracy (especially after Watergate and the revelations of CIA-Mafia plots to kill Castro) that ultimately led to a new investigation. That investigation, the House Select Committee on Assassinations (HSCA), emphasized the scientific side of the assassination and concluded that Lee Harvey Oswald had indeed fired and killed Kennedy. In addition, the HSCA concluded, largely on the basis of the acoustics evidence, that a gunman on the grassy knoll fired at Kennedy (but missed). The HSCA addressed many of the issues raised by the critics in the sixties.

Since then, the literature has taken on a disturbing tone -- one that rejects any piece of evidence contrary to findings of conspiracy. If the autopsy X-rays and photos show evidence of a single head-shot from the rear, well, they must be fakes. If the wounds on Kennedy's body are consistent with a single-gunman, well, the body must have been altered. If the neutron activation analysis shows the single-bullet theory to be correct, well, the evidence has been tampered with. And, if you do not like the conclusions of a professional panel, well, they must have ties to the government. One could go on and on. This is extremely dangerous.

This development is exactly opposite to the legitimate process of theory-building and testing. In the clash between evidence and theories, theories have to be discarded. It's true that evidence is often weak and open to multiple interpretations, but to argue that evidence is fraudulent is to undermine the possibility that any theory might turn out to be "true". . . To argue in such a style is to cause the collapse of the entire empirical edifice of assassinology. However weak, evidence could at least refute theories; now the evidence can't even do that.

The critics are practising intellectual dishonesty on a massive scale. The conspiracy they paint is too big. One must remember that the Watergate cover-up failed despite being run by a sitting President. Iran-Contra also failed despite a sitting (albeit sleeping) President that gave free rein to his administration. Yet, we are to believe that a conspiracy of multiple gunmen, massive forgery and tampering of evidence, impersonation, planting of evidence, etc. could survive without a single crack. It belies belief.

This doesn't mean that there aren't legitimate areas of inquiry. The major problem is that the critics have not yet developed a talent to filter out the unwarranted charges and focus on the more important issues. This need to throw out some sacred cows and begin to focus on the real issues cannot be overstated.

Posner's biggest mistake was in claiming that the case was closed. It's not. Dr. Gary Aguilar sums up some of the outstanding medical issues in a cogent article in the Fourth Decade. There are still questions on the acoustics evidence. Oswald's possible relationships with various intelligence agencies are in question. So, the case is still very much open. However, just as the "lone-nutters" must admit there are areas that remain to be investigated, the "conspiracy freaks" must start discarding some of their many sacred cows.
